Domino's Delivery Driver 'Became Upset' and Hit Customer with His Car After 'Not Receiving a Tip': Police

A Domino's delivery driver in Missouri allegedly hit a man with his car after not receiving a tip.

Zachary Nicholus Walton, 36, was booked in the Callaway County Jail without bond on charges of Armed Criminal Action, Assault First-Degree or Attempt and Leaving Scene of Accident – Physical Injury, according to jail records reviewed by PEOPLE.

On Wednesday, April 29, at approximately 7:21 p.m., officers from the Fulton Police Department responded to a private residence in reference to an "accident with injuries," a statement of probable cause reviewed by PEOPLE states.

It is there that a witness alleged that the delivery driver, identified as Walton, "became upset" and "struck" the victim with his vehicle.

Officers said that the victim, whose name was not released, had visible injuries to his hand.

The victim allegedly told officers that the impact with the vehicle "caused him pain and he believes he has scrapes on his shin."

The victim alleged that Walton engaged in a "verbal altercation" after not receiving a tip, "intentionally" driving his vehicle forward and striking the victim, "causing him to jump onto the hood to avoid further injury."

According to the statement of probable cause, video footage obtained from the scene showed Walton "initiating the confrontation" by yelling profanities at the witness and victim.

In the video, Walton can allegedly be heard saying the witness and victim were "f—ing rude" and, while getting in his vehicle, saying, "What are you going to do, bitch? Come get me."

The statement of probable cause states that Walton then reversed toward the runway, while the victim walked in the driveway toward the vehicle, which did not block him or prevent him from leaving.

"Walton — who was nearly entirely in the roadway —placed the vehicle in drive and accelerated forward, striking [the victim]," the statement of probable cause states. "Walton then fled the scene at a high rate of speed."

Officers later made contact with Walton at Domino's, where he allegedly admitted to driving toward the victim in his vehicle in an effort to "scare him" and admitted to leaving the scene afterwards.

"The defendant poses a danger to the victim and the community as he intentionally used a motor vehicle to strike the victim during a verbal altercation and then fled the scene without contacting law enforcement," states the statement of probable cause. "His actions demonstrate a disregard for the law and safety of others, indicating he may not comply with a summons."

The statement of probable cause notes that Walton has a prior conviction of domestic assault and false imprisonment for which he served time.

Walton had his first court appearance by video without counsel on Friday, May 1. His next hearing has been scheduled for Wednesday, May 6.
