Lindsay Clancy’s lawyer criticized police for failing to test a cup for pill residue.

Kevin Reddington appeared on CBS Mornings Wednesday, Sept. 9, to discuss the aftermath of his client’s murder trial ending in a mistrial.

Judge William Sullivan declared the mistrial after the jury failed to reach a unanimous verdict.

Clancy is charged with murder in the deaths of her children — Cora, 5, Dawson, 3, and 8-month-old Callan.

Though she admitted to fatally strangling the children, Clancy pleaded not guilty by lack of criminal responsibility, arguing that she was suffering from postpartum psychosis and overmedication at the time.

After killing the children, Clancy attempted suicide by cutting her wrists and jumping out of a two-story window.

Speaking to CBS Mornings, Reddington was asked what he felt the “single biggest failure” of the investigation was.

“I mean, here you have a cup with residue that everybody is talking about is crushed pills,” Reddington said. “There’s no crushed pills residue, there’s no analysis, nobody bothered to seize the cup and look at the residue and analyze it in the crime lab. Ridiculous.”

Earlier in the interview, Reddington repeated his claim that the jurors had voted 11-1 in favor of acquittal and that one juror stood in the way of a verdict.

“I would defend that person’s right to be a holdout for months. That’s what the system is based on,” Reddington said. “But when the forelady indicated clearly and unequivocally in the jury question that this person had doubt, reasonable doubt as we know now, and just refused to listen to the judge’s instruction on the law, that’s when I was upset because that’s when I used the expressions and the terms that I did that it just wasn’t right.”

Prosecutors have the option to retry the case, though they have not yet announced a decision.

For now, Clancy, Reddington and the prosecution are due back in court for a follow-up hearing on Sept. 29.

The jury deliberated for a week but did not reach a verdict after considering charges of first-degree murder, second-degree murder and manslaughter.
