NEED TO KNOW

  • The Lindsay Clancy jury knew the case could be a “turning point,” juror Paula Devlin told CBS Mornings
  • “This would be something that could change something to make it better for other women in the future, for other families,” she added
  • Devlin was one of 11 jurors who voted to find Clancy not guilty by lack of criminal responsibility

A Lindsay Clancy juror says the jury knew the case was potentially a “turning point” during the trial.

Paula Devlin, one of the jurors who voted to find Clancy not guilty by lack of criminal responsibility, appeared on CBS Saturday Morning to discuss her experience on the jury of the high-profile case.

During the trial, Judge William Sullivan repeatedly reminded the jurors not to read anything about the case. But despite being detached from the extensive media coverage of the case, Devlin says the jury knew the case could have lasting implications.

“Even though we didn’t know what was going on outside of our little bubble that we were in, we knew that this was a turning point, and this would be something that could change something to make it better for other women in the future, for other families,” Devlin said.

Clancy is charged with first-degree murder in the deaths of her three children, Cora, 5, Dawson, 3, and 8-month-old Callan.

Though she acknowledges killing the children, Clancy pleaded not guilty by lack of criminal responsibility. As a result of her plea, the defense is arguing that she was suffering from postpartum psychosis and overmedication at the time of the killings.

Since Clancy’s murder trial ended, several jurors have come forward and revealed that 11 of the 12 members of the jury had voted to find Clancy not guilty by lack of criminal responsibility, while one wanted to convict.

Devlin told CBS that justice for the children would be “this never happening again.”

The trial ended when Sullivan declared a mistrial after jurors said they were not able to reach a unanimous verdict.

The lone holdout juror has not yet been publicly identified.

Had she been found not guilty by lack of criminal responsibility, Clancy would not have been set free. Rather, she would be subjected to a potentially indefinite stint in a secure state mental health facility.

Clancy is in a wheelchair after she became paralyzed from the waist down, the result of a suicide attempt. After using exercise bands to strangle her children, Clancy cut her wrists and jumped out of a window in her Duxbury, Mass., home.

Clancy has been in custody at Tewksbury Hospital, where she remains following the mistrial.

Prosecutors have the ability to try Clancy again but have not yet indicated if they will. A court hearing in the case is scheduled for Sept. 29.
