Erika Jayne is opening up about where she stands with estranged husband Tom Girardi.
During the Thursday, Dec. 11, episode of The Real Housewives of Beverly Hills, Jayne, 54, invited costar Sutton Stracke to a spa day and told her she’s still “not over” Girardi’s legal troubles or imprisonment.
“I’m heartbroken,” Jayne said. “It f—— sucks knowing that person and being married to that person for so long. Then to see him walk down the courtroom steps like that knowing he’s going to die in prison, that’s heavy on any level.”
Stracke asked Jayne if she plans to “say goodbye” to Girarardi, who reported to prison in July to begin his seven-year sentence. In 2024, the disbarred personal injury lawyer was convicted of four counts of wire fraud following a 13-day trial after embezzling more than $15 million from his clients over 10 years, from 2010 to 2020.
“I don’t know, but I’ve thought that exact same thing, ‘What do I do?'” Jayne said. “I said this to somebody the other day, I just kind of hoped he’d die before he’d go to prison, just so he could get it over with.”

Jayne told Stracke that Girardi was “sentenced on his 86th birthday” in June and is “really not in good health.” In a confessional, she said that she has “thought” about visiting Girardi in prison but has asked herself, “Would he even want to see me? Would he know who I am? Is there going to be some magical answer to all the questions I have? No.”
“I’ve realized through a lot of therapy sometimes you’re not getting closure — you have to close it yourself,” she said. “Five years later, I’m still fighting my way out of this. I still have civil cases that are in motion. I don’t know that I’ll ever get away from any of this. I don’t know what happens to me in the end.”
Jayne filed for divorce from Girardi — who was previously diagnosed with dementia and late-onset Alzheimer’s — in 2020, after 22 years of marriage.
Less than a year later, news of his legal troubles began making headlines, leaving fans speculating about Jayne’s involvement, although she has maintained she had no knowledge of the crimes and has not faced any indictments.
