Render alleges in a filing that her daughter has expressed that she feels "unsafe" in her current custodial situation

Dwight Howard's ex Tiffany Render has been denied an emergency order for temporary custody of their daughter Layla.
According to court documents obtained by PEOPLE, the NBA champion's ex requested an emergency order for custody of their 15-year-old daughter, Layla, on Monday, Mar. 16. In her initial filing, Render said she was submitting the emergency order because she had "serious and immediate concerns" about her daughter's wellbeing and safety.
"Layla was recently admitted to a mental facility after expressing thoughts of harming herself and has repeatedly stated that she feels fearful and emotionally distressed about returning to her father's home which she believes contributed to her crisis," Render claimed in the custody modification, alleging that the situation resulted in involvement from the Georgia Division of Family and Children (DFACS).
Howard and Render didn't immediately respond to PEOPLE's request for comment.

Render explained that she feels that, given her daughter's mental health situation and the risk to her well-being, it is in Layla's best interest to live with her until the matter can be reviewed by the court. Layla also submitted an affidavit of custody election, requesting to live with her mother.
On Tuesday, Mar. 17, Render's request for an emergency order was denied by the court. The judge explained that Render hadn't filed the controlling custody order she wanted to modify and added that they didn't see the case as an emergency.
Render will have to file the appropriate document, and the court will settle the matter in a temporary hearing.
This latest news comes after Howard has been embroiled in personal matters involving his wife of 14 months, Amber Rose Howard — a rapper who goes by the name Amy Luciani.
PEOPLE confirmed that authorities were called to his Suwanee, Ga. home three separate times on successive days from March 5-7 for what police say were a suicide threat, a domestic incident and a theft report.
Hours after Howard filed for divorce on Monday, March 9, from Amber Rose, she also filed for divorce, TMZ was first to report. Amber Rose had previously filed for divorce last summer before the two reconciled.

On Mar. 12, Howard announced that he is officially retired from the NBA, shared his news on social media in a lengthy post in which he said he would focus on personal matters — “to pour into my family” — days after he filed for divorce from Amber Rose.
“Woke up today on the 12th of this month and I figured it’s time to move on from Superman!” Howard, 40, wrote on X. “Im no super human… I cry ! I struggle! I feel like everyone else. Through the lies, the media and the hate I still show love and Smile Through The Storm.”
He continued, “But now Im taking off the cape and retiring from all basketball to pour into my family and give back to communities worldwide. I know some of you might think I thought he already ‘retired’ but I didn’t… the game retired me! I still had more left to give ! Yeah I did play professionally for 20 years and Im grateful to be able to say that but I can’t lie seeing these other players still going at it at age 40 inspired me to want to keep trying but now I believe my duty will be to pass it down to the next generation.”
